TY - JOUR AU - إسعون, محفوظ PY - 2018/03/04 TI - مفهوم العدالة الجنائية التصالحية في الجرائم الإرهابية JF - revue mofakir; No 16 (2017): مجلة المفكر KW - N2 - إذا كان تكريس العدالة الانتقالية يعتمد على آليات:معرفة الحقيقة،إحياء الذاكرة،الفحص والإصلاح المؤسسي،المحاكمات،جبر الأضرار،فإن العدالة الجنائية التصالحية عموما والعدالة الجنائية التصالحية في الجرائم الإرهابية بالخصوص،هي العدالة التي تجمع تدابيرها بين العدالة الجزائية والعدالة التصالحية،مع ضمان أن تكون الأهداف متوازنة مع الحاجة إلى السلام،أي الموازنة بين العدالة في شقيها المحاسبة والجبر وتحقيق السلام الاجتماعي. وتعتمد على آليتي المحاكمات وجبر الأضرار،بالنص عليهما إما في القوانين الجنائية العادية (الإجرائية و الموضوعية)أو في القوانين الاستثنائية(كقوانين المصالحة الوطنية)،وتم الأخذ بها في الجرائم الإرهابية باعتبارها من أخطر الجرائم،بعد النجاح الباهر الذي عرفه هذا النمط من العدالة في المخالفات والجنح،متمثلا في الصلح الجنائي،الوساطة الجنائية التسوية والأمر الجنائيين.   Abstract: The consecration of transitional justice depends on the mechanisms of the knowledge of the truth, the restoration of the memory, the institutional control and reform, the lawsuits and the repair of the damages. The criminal restorative justice in general and the criminal and the restorative justice of terrorist offenses in particular, combines its measures between criminal justice and restorative justice, while ensuring that the objectives are balanced with the need for peace. Which means, to balance justice at both ends with responsibility, reparation and the attainment of social peace. It relies on the mechanisms of lawsuits and reparations, providing for them either in ordinary criminal laws (procedural and substantive), or in exceptional laws (such as laws of national reconciliation). This type of justice has been introduced into terrorist crimes, which are considered one of the most serious crimes, after the great success that it has experienced in irregularities and offenses, represented in criminal reconciliation, criminal mediation, criminal regulation and order.
