التدخل الدول الإنساني بين المشروعية والاختراق

أعطت نهاية الحرب البادرة فضاءا جديدا لمجلس الأمن الدولي للتحرك في مجال التدخلات العسكرية و الإنسانية
وذلك لحفظ السلم و الأمن الدوليين، و هذا إما بطريقة مباشرة أو عن طريق المنظمات الدولية و الإقليمية، حيث
ساهم ظهور جيل جديد من النزاعات بعد نهاية الحرب الباردة، حالة من السيولة في العلاقات الدولية التي طبعها
انتشار قيم و مبادئ الديمقراطية و حقوق الإنسان. و من ثمة الحاجة إلى بلورة مفهوم جديد للأمن يتخذ من الفرد
وحدة أساسية له، و بالتالي أدى هذا إلى تغير في وظائف القانون الدولي التقليدي الذي يمنح للدولة الوطنية بتوفير
الحماية للسيادة الإقليمية و الاستقلال السياسي، و هو حق الدولة بممارسة جميع اختصاصاتها الإقليمية، لكن في
المقابل نجد أن هناك دول و منظمات قد أوجدت لنفسها الحق في التدخل من خلال مبررات و آليات وأساليب
منها مشروعة كحماية حقوق الإنسان أو لحماية المدنيين هذا من ناحية، و من ناحية أخرى هناك دوافع و أهداف
تسعى إلى تحقيقها من خلال اختراق سيادة هذه الدول.
the end of the cold war gave the UN security council new space to move in the field of military and humanitarian interventions in order to maintain international peace and security; and this either directly or through international and regional organizations; as the emergence of a new generation of the conflicts after the end of the cold war; contributed to a state of fluidity in international relations marked by the spread of the values and principles of democracy and human rights.
And there is a need to crystallize a new concept of security that takes the individual as its basic unit; and thus this led to a change in the functions of the traditional international law; which grants the national state by providing protection to territorial sovereignty and political independence; which is the right of the state to exercise all its regional powers; but in on the other hand; we find that there are states and organizations that have established the right to intervene through legal procedures; mechanisms and methods; including legitimate ones; such as protection of human rights or the protection of civilians; on the one hand; and on the other hand, there are motives and goals that they seek to achieve by penetrating the sovereignty of the countries.
